GREAT AUSTRALIAN PLATYPUS SEARCH MOBILE APPLICATION TERMS AND CONDITIONS OF USE

Odonata Foundation Ltd (ACN 620 085 583) (Odonata, we, us, or our) is a not-for-profit entity which supports biodiversity impact solutions. Odonata provides a mobile application as a collection tool for citizen scientists (you or your) to enter information and data relating to the Great Australian Platypus Search (the App). These terms and conditions represent our agreement with you relating to the App. By using the App, you are agreeing to these terms and conditions.

Use of the App

The App is provided “as is” and without any warranty or condition, express or implied. To the maximum extent permitted by law (including, without limitation, the Australian Consumer Law) we make no warranties or representations about the App and its content including (without limitation) warranties or representations that the App will be complete or current.

We provide access to the App and its content on the basis that you assume all responsibility for any loss, damage or consequence resulted directly or indirectly from your use of the App. You are liable for all charges incurred as a result of telephone communication and data expenses associated with using the App.

Use of the sampling kits

Sampling kits used for the collection of water samples are provided by EnviroDNA (sampling kits). You must use the sampling kits in accordance with the written directions provided by EnviroDNA and enter the data into the App in accordance with any instructions included on the App.

Warranties

You warrant to us on a continuing basis that all data collected and entered by you into the App is accurate. You must use your best efforts to collect and enter data to the best of your abilities and in accordance with any instructions provided by us to you.

Release of liability

Odonata, together with its officers, employees, agents and contractors (collectively the Odonata Parties) will not be liable for, and to the maximum extent permitted by law you release the Odonata Parties from, any claim or liability in respect of any loss, injury or damage whatsoever or howsoever caused which you may suffer or experience, as a result of using the sampling kits, the App and otherwise from your participation in the Great Australian Platypus Search.

If you are under 18 years of age, you warrant to us that you have obtained your parent or guardian’s consent to agree to these terms and conditions on your behalf.

Privacy

You may submit your personal information, including your name and contact information to register for an account with the App or through your participation in Great Australian Platypus Search (Personal Information). We may use your Personal Information in accordance with our Privacy Policy.

General Provisions

Odonata may at any time, and without notice to you, alter the functionality and/or appearance of the App.

Odonata may immediately terminate or suspend your access to the App or remove or reject you from the App or your participation in the Great Australian Platypus Search if you breach, or are reasonably suspected of breaching, these terms and conditions.

You acknowledge and agree that these terms and conditions do not create any relationship of partner, agency, employment, trust, partnership or joint venture as between you and Odonata.

These terms and conditions constitute the entire agreement between you and Odonata relating to the App and are governed by the law in force in the State of Victoria, Australia. You irrevocably submit to the non-exclusive jurisdiction of the Courts of Victoria.

Odonata Foundation Ltd’s Privacy Policy

In this Privacy Policy, ‘us’, ‘we’ or ‘our’ means Odonata Foundation Ltd (ACN 620 085 583) (Odonata). At Odonata, we are committed to respecting your privacy. Our Privacy Policy sets out how we collect, use, store and disclose your personal information.

By providing personal information to us, you consent to our collection, use and disclosure of your personal information in accordance with this Privacy Policy.

1.          The type of information we collect

The type of personal information we collect from you depends on your dealings with us. Where possible, we collect personal information directly from you. The personal information we collect from you may include, but is not limited to:

1.1.       information about your identity, including your name and contact details (such as your address, email address, telephone number);

1.2.       your age, gender, and date of birth;

1.3.       credit card information or other financial details;

1.4.       details of the products or services we have provided to you or that you have enquired about, including any additional information necessary to deliver those products or services and respond to your enquiries;

1.5.       any additional information relating to you that you provide to us directly through our website;

1.6.       information you provide to us through surveys or other promotional activities; or

1.7.       any other personal information that may be required in order to facilitate your dealings with us.

1.8 we ask the following permissions when using the app:

  1. Camera Permission

    1. Camera access needed for capturing pictures and videos of the river and surroundings.

  2. Photo Library Permission

    1. Photo library access needed for uploading pictures and videos of the river and surroundings from the photo library.

  3. Storage Permission

    1. Photo library add-only access needed for saving pictures and videos of the river and surroundings.

  4. Location Permission

    1. Precise location access needed for recording sample collection location.

  5. Microphone Permission

    1. Microphone access needed while recording videos of the river and surroundings.

2.          How we collect information

We may collect personal information about you in a number of ways. Primarily, we will collect information from you when you use our website, participate in one of our community programs (e.g. a citizen scientist program), join one of our mailing lists, purchase our products or services, communicate with us or any other time you provide personal information to us.

Sometimes we may collect personal information about you from third parties who provide services to us or on our behalf.

We may also collect personal information from you through cookies used on our website (discussed further below).

3.          Cookies

 
Some information may be automatically collected through our use of ‘cookies’ on the website. Cookies are small files installed in your browser or on your device used to recognise customers that revisit our website and help us to enhance and customise your experience.

Cookies provide us with information about customer behaviour such as pages viewed, products or services purchased and the customer journey around our website. Information collected from cookies may include personal information.

We generally use and disclose your personal information for the purpose for which it is collected, including:

4.1.     as part of your involvement in a community project;

4.2.     to send communications, respond to your enquiries or to provide information requested by you;

4.3.     for marketing and promotional purposes, including to send you information about our products and services, surveys or other promotions and value-add services that we think may be of interest to you; and

4.4.     to comply with our legal obligations, handle any disputes, queries or complaints, investigate or detect crime, fraud or anti-social behaviour and enforce our agreements with third parties.

5.          Sharing your personal information

Your personal information may be disclosed to our employees, officers, directors or related bodies corporate. We may also share your personal information with our contractors and community partners.

Where you have expressly authorised a third party to receive certain information held by us, we will disclose such information to that authorised third party.

If our business or assets are sold or transferred, we may disclose your personal information to the purchaser, potential purchaser (including their advisors) or any successor in title of our business and/or assets.

Your personal information may also be disclosed to regulatory or investigative bodies, government or law enforcement agencies or as otherwise required or permitted by law. In such circumstances we are not under any obligation to try and restrict disclosure of your personal information.

6.          Promotional communications

From time to time, we may send you promotional communications and information about our products and services or the services of our trusted third party partners.

If you prefer to not receive promotional communications from us, you may opt-out or withdraw your consent at any time by contacting us or by using the unsubscribe facility we offer in our electronic messages.

7.          Security of your personal information

Security of your personal information is important to us and we take reasonable steps to protect the personal information we hold from misuse, interference and loss, as well as unauthorised access, modification or disclosure, as required by the Privacy Act 1988 (Cth) (Privacy Act).

While we endeavour to ensure your personal information is protected, we cannot guarantee the security of personal information you disclose to us.

8.          Third party websites

We may display content or links to websites operated by third parties on our website. Such content or links are not operated by us and are provided for your convenience only.

If you click on any content or links of a third party you may leave the Odonata website, in which case the collection, use, storage and disclosure of your personal information will be governed by the privacy policies and practices of the relevant third party. We are not responsible for the privacy or security practices of third party websites.

9.          Anonymity

You may deal with us using a pseudonym or without providing us with any personal information. Please note however that if you provide a pseudonym or choose to remain anonymous, we may not be able to provide you with certain services which require us to know your correct identity.

10.       Access and correction

You have certain rights to access personal information we hold about you. To request access to personal information we hold about you, please contact our Privacy Officer. We will generally provide you with access to your personal information subject to some exceptions under the Privacy Act.

We try to ensure that all information we hold about you is accurate and up to date. You can keep your information up to date by letting us know of any changes to your personal information. If you would like to request that we correct or update any personal information we hold about you, you may do so by contacting our Privacy Officer.

We may take reasonable steps to verify your identity before granting access to or correcting your personal information.

Where we no longer require your personal information, we will take reasonable steps to destroy the information or ensure that it is de-identified unless we are required by law to retain the information.
